In Florida, theft is when a person knowingly obtains or uses, or endeavors to obtain or use, the property of another person with the intent to, either temporarily or permanently…

  • deprive the other person of a right to the property or a benefit from the property
  • or appropriate the property to his or her own use or to the use of any person not entitled to the use of the property

Depending on the type of property stolen and the value of the property stolen, theft crimes can range from misdemeanors, to 3rd degree felonies (punishable by up to 5 years in state prison), to very serious 1st degree felonies (punishable by up to 30 years in state prison). However, the most common theft crimes are petit theft (when the value of the property stolen is from $0 to $300) and 3rd degree grand theft (when the value of the property is from $300 to $5,000).
The experienced attorneys at Pensky & Kim have handled thousands of theft crimes overs the years. In many theft cases, we are able to have the case dismissed, or at the very least resolve the case in a manner that will not leave you with a permanent criminal conviction on your record.
